Yes but widely used, especially by restaurant owners in NYC.

I frankly like that fact that if someone in a restaurant absolutely
has to make a phone call, they must excuse themselves to the bar or go
outside. It fosters a desirable form of etiquette.

It should be legal in private establishments.
