Default e911 tax on data only cellular plans

I'm working on an issue regarding e911 fees on data only cellular
plans. In the states I've researched, e911 fees should not be charged
(by law) on data only plans. Anyone have data only plans who is being
charged this fee? It's typically 1.50 per month but can range from
0.30 to 3.00 dollars depending on the address of the subscriber. This
can add 5% to the cost of a data line, and when you've got hundreds or
thousands 5% adds up.
