It's Father's Day here in the USA, UK and Canada (best wishes to all
the Mac daddies out there!), and if the tea-leaf-reading over the
iPhone 3G S launch is accurate, it looks like quite a few of those
dads may have gotten a shiny new phone as a gift from the spouse and
kids. Which would have been really thoughtful and unexpected. If I had
gotten one. Anyway.
The pre-launch expectation from analyst Gene Munster was for a
comparatively modest 500K units sold over the weekend vs. the 3G
million-phone launch, but now his firm has suggested that may have
been a conservative number, as noted by AppleInsider. Between AT&T's
citing of 'hundreds of thousands' of pre-orders for the phone, and O2
announcing that first-day sales for the 3G S blew past the totals for
the 3G last year, it's possible that the 3G S could creep up towards
that million-phone number and blockbuster territory.
Despite (or perhaps due to) the brisk sales pace, AT&T's activation
infrastructure did not seem to be ready for the influx of account
changes; this is a familiar situation, as last year's 3G launch
triggered similar delays. Many new buyers (including our own Steve
Sande) were faced with activation delays between two hours and two
days. In recognition of the aggravation and inconvenience, Apple has
begun emailing affected users with the offer of a $30 iTunes credit to
be delivered Monday morning, according to Everything iCafe. If you got
a credit email, please let us know.
Maybe next time Apple and AT&T will let online sales be delivered and
activated a week or two before they let the rest get theirs via
retail. Ot maybe release it in waves first in the SE then the NE
working you way across the country for a couple of weeks instead of
all at once.

Or maybe next year Apple will allow iPhones to simply work like every other
GSM phone on the planet, and not require "activation." Subtracting the
probable large number of upgraders from the "activation server" would've
probably lightened the load. Why an existing AT&T customer can't just stick
his or her existing working SIM into an iPhone without cradling it to a
computer and "phoning home," just like any other phone, is a mystery I'll
never understand.

It is no mystery. The reason is the same that Sauron forged the One Ring;
to dominate all the others. Steve Jobs is a control freak; and Apple
takes its lead from him.
Legally, Apple has no right to control what consumers do with their iToys.
Title transfers to the consumer when they buy it. Apple's claim, such as
it is, is that they are merely enforcing their software license, as if
otherwise someone will run the iToy firmware on a Zune.

I understand the need for DRM, protection, licensing, etc., but I haven't
figured out the need for "activation." AFAICT, the phone is recognized by
iTunes by serial number, and your iTunes account by username/password- I
don't see where activation comes into play except as a user anoyance.

While the sales are certainly impressive, I'd suggest in the future, Apple
rethinks their press releases a little better.

It could all be controlled by SIM, but Apple and AT&T want even tighter
control by IMEI.

That was the experience at the Rogers dealer where I went this weekend,
although I spelled it "no one" -- In fact, not a single non-employee
wandered in or out of the store the whole 75 minutes I was there.
Why 75 minutes you ask? Rogers' dealer POS system was down, as was
Apple's activation servers, each took an excessive amount of time to
resolve.

But even IMEI could be controlled at the network level, without
inconveniencing the customer. E.g. when an iPhone is detected, block data
unless the customer has an appropriate plan. T-Mo handles it that way for
G1 phones. G1 customers don't need Goggle's "permission" to make their
first phone call.

Sounds like they need to release a new model every month and they'll
sell ok.

Actually, title would transfer to the consumer when his CONTRACT WAS UP, at
which time the unit has been paid for! People are borrowing money from the
Borg to buy the thing subsidized. It's not YOUR phone until YOU pay the
sum total of the monthly fees!

This must have been quite short of investor expectations:
AAPL today:
Last Trade: 137.37
Trade Time: 4:00pm ET
Change: Down 2.11 (1.51%)
Prev Close: 139.48
They are the only people at Apple that actually matter. They own the
place! Some were not amused.....
From CNBC:
"said it sold more than 1 million units of its newest iPhone, the 3GS,
in the first three days of launch. But shares were still lower as
investors remained skittish over the health of CEO Steve Jobs. CNBC
confirmed Jobs had a liver transplant several months ago."
Investors are really pissed off about NOT being told by the Board of
Directors, who MUST tell them the truth or else. Some heads at
Cupertino need to roll on this one. A lot of people risk a lot of money
on AAPL and there's no excuse to shut them out of knowing EXACTLY what
the health of the company brass is at all times.
Someone needs to kick some ass at HQ to remind them this is a PUBLIC
company.....not their private island.

Actually, no. But it's a good question.
The way the contact is structured, you get a "free phone" or "discounted
phone" with a "service commitment" and "early termination fee". It's not
a "finance plan" or a "lease to buy", although in some states you'll pay
sales tax as if it was such. Nor is there a lien on the phone or
repossession if you fail to fufill your obligations.
If they want to retain title until contract fufillment, they need to word
the contract that way. But if they did that, they wouldn't be able to
maintain the fantasy of a "free" or "cheap" phone. Oh dear, oh my...
If you fail to hold up your end, they'll piss on your credit rating and
blacklist the phone's IMEI/MSN, but they can't take the actual phone back.
Similarly, if the contract was structed as a finance plan or lease to buy,
then when the contract term is reached the monthly payments would be
reduced by the amount of the finance/lease fees. As we all know, no such
thing happens; you simply become a month-to-month customer with no service
commitment who can cancel at any time.
In short, title to the phone does transfer immediately.

I've always viewed pissing on someone's credit rating as a "feature", not a
bad thing. Anyone in 2009 in debt up to their nose from poorly disciplined
spending on a good credit rating knows what I'm talking about.
My credit rating must be fine. I got 4 pre-approved credit card apps in
the last 7 days....even now!
