Default Do you want to use a smart phone with Verizon and NOT PAY for a data plan?

Today, if you want to use a smart phone with Verizon - you HAVE TO PAY
for a data plan around $30/month - even if you want to connect to the
Internet with Wi-Fi connection only. It is an anti-consumer act - it
is the same as a TV cable service forcing you to pay monthly laundry
fees in case you use their cable box.
Verizon is phone company and they have no right to force us to pay for
a data service we don’t need.

What you can do? You can fight.
How? Send a complaint letter to your representative, FCC, or consumer
groups.

Dear Sir/Madam

I purchased a smart phone which is compatible with Verizon cellular
service. I was told by the Verizon representative that if I want to
use a smart phone - in addition to the normal cellular phone service I
have to purchase additional service - a data plan – about $30/month.

How come Verizon has the right to force me to pay for the service I
don’t need?
Is there any legal way I can stop it?

So if you agree with me - spread the news.

Why not activate your phone on Page Plus rather than on Verizon proper?

I live in NYC and I tried AT&T, Sprint and T-Mobile - Verizon has the
best service coverage in NYC. From time to time I also hike
Appalachian Trail - Verizon has very good coverage on Appalachian
Trail in NY, NJ, PA and CT.
I like their service, but not the crap with data plan.

Extremely old news.

This issue has been vetted in the courts; and has held that Verizon
*is* within its rights to require a data plan for certain devices it
sells.

No, it's be like them requiring you have to have a higher tier to use
their box.

Sure they do. It's their service in a competitive market. If McDonalds
decides tomorrow to only sell Big Macs with the purchase of fries and a
Coke, that's their right as well. If you don't like it, shop elsewhere.

Or you can buy a dumbphone, or use a cell carrier with different policies.

Be careful what you wish for. Cellular needs more competition, not more
regulation. If the Feds waive a magic wand and block stuff like this,
carriers would just retaliate buy rasing voice rates. Instead of $40
voice and $30 mandatory smartphone data, you'll end up $70 voice and
"free" data, and screw over the dumbphone users.

It's their service to sell as they see fit. Vote with your wallet and
use someone else's. If consumers resisted this nonsense by not buying
it, carriers would have to react.

T-Mobile, my carrier, handles it slightly differently. If you but your
smartphone subsidized, they force a data plan as a condition of the
subsidy, under the argument that they subsidize smartphones to a greater
extent than dumb phones, and the data fees help recoup the extra subsidy.
However, if you pay full price for your smartphone, or obtain it outside
of T-Mo (eBay, Craigslist, etc.) T-Mo doesn't force you to but a data plan.
Verizon forces you regardless of what you pay our how you obtain the
phone. I just avoid getting my phones from T-Mo, and avoid smartphone
data plans.


Frankly, if you want a smartphone without data on Verizon, you should use
a Verizon reseller like www.PagePlusCellular.com. They have cheaper
plans (unlimited voice and messaging for $40, 1200 minutes and 1200
messages for $30) use the same Verizon network, and don't have contracts.
The only "catches" are you don't get subsidized hardware (though the
cheaper rates more than make up for that) and Verizon doesn't let them
activate iPhones under any circumstances, so look at Android, Blackberry
or Windows phones.

I have four phones on the Verizon network with no data plan, but can
access the web.

The key is to activate on Pageplus, which is a Verizon MVNO. But you
bring your own smart phone. Fortunately there are tons of gently used
Droids on craigslist. An HTC Incredible in excellent condition goes for
around $100. An original Droid for around $75.

The carriers can do pretty much anything they want in terms of pricing,
and the market will decide.

Unfortunately craigslist is way too local.
I never see prices this good on it.

You misunderstand. Pageplus operates on the Verizon network. Verizon
provides the voice service. Verizon provides the data service (if you
want data). Verizon provides the voice mail service (back door Verizon
voice mail numbers work for Pageplus). Verizon provides the texting
sevice (xxxxxxxxxx@vtext.com works for Pageplus).

Note that there is another plan launching on December 20th, 250 minutes,
250 text/MMS messages and 10 MB of data for $12 per month. It is not
shown on their web site.

The key differences:

1. On Pageplus, if you roam off the Verizon network onto other CDMA
networks then there is a 29˘/minute charge. If you roam a lot then
Pageplus isn't a good choice, but if you only roam off of Verizon
occasionally then the roaming charges are not a big problem.

2. You bring the phone. Any Verizon phone will work other than Verizon's
own prepaid phones. Supposedly iPhones and Blackberries will work though
they are not officially supported. Android phones are fine.

For many people the fact that they have to pay full price for a smart
phone is the deal-breaker, but the reality is that the cost savings are
quickly recovered in the lower monthly charges. There are loads of
gently used Verizon Android phones in near perfect condition available
at low cost.

3. No high-use data plans. On Pageplus you can choose from no data (pay
as you go), or plans with 10MB (soon), 20MB, 100MB, or 500MB of data. If
you're a heavy data user and need GB of data then Pageplus is not a
viable option.

4. The cost. As an example:

Unlimited voice ($69.99), 1000 texts ($10), and 300MB ($20) of data on
Verizon will be $99.99/month plus taxes and fees, or about $115/month total.

Unlimited voice, unlimited texts, and 500MB of data on Pageplus will be
$55/month total.

So Pageplus would be $60/month less, or $1440 less over two years of a
Verizon contract.

Personally, I'm on their $29.99 plan which is 1200 voice minutes, 3000
texts, and 100MB of data. Since wi-fi is so ubiquitous I use very little
3G data, but there are times when it comes in handy.

5. No contracts. Pageplus is all prepaid. You can switch prepaid plans
anytime, or leave anytime, without penalty.

You can port your phone number to Pageplus.

I just got my daughter an HTC Incredible in pristine condition for $100
on craigslist. We met at the local Verizon store to verify the ESN,
though I did find a way to do the verification on-line if the seller is
willing to supply the ESN.

The prices vary all over the place. I've seen people advertising the
original Incredible for $250 on our local craigslist, and I've seen them
for well under $100 if not in perfect condition. I doubt if the ones for
$250 sell. Patience is the key. There are a lot of Android phones coming
on the market every month as the two year contracts expire and the
Verizon customer gets a new phone, often an iPhone.

Another option is digicircle.com, where the cost is a bit higher but you
have at least some guarantee that the phone is okay. They have the
Incredible ranging from $126 (Very Good) to $140 (Like New). The Eris, a
step down from the Incredible, is well under $100. <http://digicircle.com>

Then there are the Verizon phones with "bad ESNs" (reported stolen, or a
broken contract where the ETF was not paid) that get converted for use
on MetroPCS, that doesn't use Verizon's database of bad ESNs. Those are
even cheaper.

Actually those taxes and fees can add a lot more than that. The average
in the U.S., just for taxes, is nearly 15% for combined state, local,
and federal taxes. Look at <http://www.ksefocus.com/pdf/wireless_tax.pdf>.

Then you need to add all the non-governmental fees that the carriers
impose, Local number portability, E911, Universal Service Fund, etc.. On
a $100/month plan you could easily pay $115-120.

A good comparison of costs is for Pageplus's most expensive plan versus
what something similar would cost you on Verizon proper.

Verizon: Unlimited voice ($69.99), 1000 texts ($10), and 300MB ($20) of
data on Verizon will be $99.99/month plus taxes and fees, or about
$115/month total.

Pageplus: Unlimited voice, unlimited texts, and 500MB of data on
Pageplus will be $55/month total.

As I told one relative, "You have to decide if the monthly savings are
worth it to you considering that you will have the up-front cost of
buying a new (or used) smart phone."

I know people whose prime concern is that they are able to get a
subsidized phone, and are happy to pay $200 for a smart phone and $120
per month, but not pay $450 for a smart phone and $55 per month. There's
nothing wrong with that, it's their money and their choice. That
up-front cost of $450 is a tough pill to swallow for some people.

I suspect that like most people he has no idea what Pageplus is. Some
people I tell about Pageplus do not understand what an MVNO is, do not
believe that is is possible that cellular service can be that
inexpensive, and do not realize that Verizon, like most carriers, sell
the use of their network through MVNOs.

It sounds like he acquired a smart phone somehow and mistakenly thought
he could use it with his current Verizon service that lacks a data plan,
and use data only via Wi-Fi. It's something that a lot of people would
like to do with smart phones (just as the vast majority of iPad sales
are for the wi-fi only version because so few people want to pay for a
3G data plan). Verizon doesn't allow it (nor do other carriers) because
the cost of the data plan helps defray the handset cost. He could also
still be under contract, and unable to switch to Pageplus without paying
an ETF. I had to wait out my Verizon contract.

Can you imagine the amount of smart phone business Verizon would lose if
a) more people understood what Pageplus is, b) looked at their actual
monthly data usage, and c) could do math? You have people like the
original poster that absolutely will not leave Verizon because they need
the coverage, would like a smart phone, but aren't interested in a plan
that costs them $80-120/month. Pageplus is pretty much the only option.

Now for the converse: instructions how to get a handset to send
to an email address via SMS technology only.

For example, on T-Mobile: compose a message as follows

: user@emailaddy.TLD # subject # message body

and send it to 500 (T-Mobile's SMS-to-email gateway).

On other carriers, how, if you know? Many TIA!

I personally don't trust Craigslist; I'd buy off eBay instead, because
at least on eBay they have a way that you can verify the seller's
reputation (and if the seller is engaging in outright fraud, you have
recourse, which you do not have on Craigslist).

Just my 2 cents, your mileage may vary, etc., etc.

Yep - you right Doug,

I am just whining about stupid $30/month Verizon want from from me for
the services I don't need, even I paid full price for the Verizon
phone.
You are right - consumers should pay without whining any price a
corporation desire. And if we protest the corporation will layoff
workers, move overseas or collapse and we will have to bail them out.
Now I see I should ask Verizon to charge me not only $30/month for
services I don't need, but also to buy their CEO Christmas and
Channuka gifts.

Thanks a lot!!!

Very useful information. I called PagePlus - I was told they will not
activate Iphone. I own HTC HD2 for T-Mobile which I use as PDA only
and I wrote few application for myself, but even Droid is OK - I just
will have to learn how to convert my applications from WinMobile to
Android.
I am considering switching to PagePlus.

You've got the contact information. I.e. I checked the sellers home
address, and I verified that the phone had a clean ESN by meeting them
at a Verizon store to have it checked.

You were informed exactly how to stay on the Verizon network without
paying the $30/month for a data plan. This is something that a great
many people on alt.cellular.verizon have already done. What more do you
expect? Verizon wireless's prices are not subject to any state or
federal regulation. Since you paid full price for the smart phone you
are obviously not under contract with Verizon.

Do you know of a list somewhere of which smartphones will work (or not
work) with all features on PagPlus? It would be good info to have
before buying a phone .

When you buy the 3G iPad on AT&T you must sign up for a $14.99 or $25
per month plan. You can then cancel it so it doesn't renew and add it
back a month at a time. I don't think the reason people are not
purchasing many of the 3G iPads is the extra $130, it's that they don't
want another monthly fee and they don't want to be constantly cancelling
and restarting the purchase of data. They may also figure that with
Wi-Fi so widely available why bother with 3G.

No. Pageplus will not put out such a list.

Any Verizon Android phone (other than Verizon prepaid Android phones if
they exist) will work.

Some people claim to have activated Blackberry phones, but of course
there will be no access to the RIM servers.

Verizon iPhones have been activated. There was also a story that in
order for an iPhone to be activated on Pageplus it must first have been
activated on Verizon, which having a month of service on Verizon (with
no contract) at $70, then changing to Pageplus. An expensive proposition
after paying full retail price for an iPhone. There are quite a few used
Verizon iPhone 4's for sale now, at around $300-350, and they've already
been activated once on Verizon. Pageplus did say at one time that they
did not support the iPhone, and some people worry that Verizon will
check ESNs at some point and deactivate iPhones on Pageplus.

It's a little strange to me that since few people know about Pageplus,
that a used Verizon iPhone4 would have so much value since a new or
existing Verizon customer could get a subsidized iPhone 4S for less than
the cost of what a used iPhone 4 costs. Either way you're paying for a
Verizon data plan. Unless you don't plan to stay on Verizon for 2 years.
