Below is a copy of a letter I sent today. Hopefully I can report back that
I have received my refund.


May 4, 2007

Phones 2 U Direct

Dear Sirs,

LETTER BEFORE ACTION

I refer to my letters dated the 14 December 2006 and 12 March 2007 and also
my email of 23 March 2007, all of which refer to my cash back claims. I
have received no reply to any of these communications. I know that the
above letters were received by you as these copies from Royal Mail show:
Your item with reference DH641740303GB was delivered from our SEVENOAKS
(RURAL) Delivery Office on 20/12/06.
Thank you for using this service.

The electronic Proof of Delivery for this item is now displayed below

Your item with reference DL013473110GB was delivered from our SEVENOAKS
(RURAL) Delivery Office on 14/03/07.
Thank you for using this service.

The electronic Proof of Delivery for this item is now displayed below.

I have fully complied with all the conditions of your cash back offer and I
ask that you do the same. If I do not receive monies due to me within the
next seven working days, I will have no alternative but to issue
proceedings in the County Court without further notice.

If it is necessary to pursue this course of action, please note that I
intend to pursue a claim for a full refund, plus interest, together with
any incidental costs incurred.

Only the company will deal with you, do you not understand the difference

He's posting here to show people what he has done. I think you will find
that he has also sent the letter by recorded mail to the company
concerned.

good luck - I did the same with no response

Took them to court via the moneyclaim online service

They filed a defence but didn't turn up for the hearing in my local court

I got the full year's cashback, court costs and 2 hours pay for the time off

P2U settled the award within a week of getting the court result

A quick follow up. On Friday I received the cashback for my first claim,
that still leaves the second outstanding. If I don't get a cheque tomorrow
I will send another "Letter before action"

action.
