The line has to be drawn somewhere. All legal cases have to "pass
a test" to determine whether an offence has been committed. Choice
of some particular speed gives an objective test.

Its obviously true under some circumstances.. do you have a problem with
that?

The difference between breaking the law, and not breaking the law. That
might sound petty, but what happens when you set the speed limit at
93.7865343 miles per hour. Well, when you travel at 93.7865342 miles per
hour you are within the law and when you travel at 93.7865345 miles per
hour you are not. The difference between the two will make absolutely no
difference in an accident or when you run over that child that dashed
out in front of you, but the imit has to be set somewhere, and it has to
be an arbitrary position, because there is no other way to enforce it.

Unlikely, but if you're going to impose speed limits you have to draw
the line somewhere.
The problem is that too many people are so lacking in driving skills
that they need fixed rules like to be enforced to protect others from
them. On any given stretch of road, you can't say that one particular
fixed speed limit is always appropriate. Depending on a variety of
factors such as weather conditions, proximity to pedestrians, time of
day, visibility, road surface conditions etc. the maximum safe speed
will vary enormously even over just a few yards. Unfortunately,
because so many idiots fail to recognise that they're driving too fast
in dangerous conditions we need to impose lower limits for everyone.

It doesn't help that you have the idiots here that will ignore the limit
anyway as "they" are better drivers than everyone else so can speed safely.
This makes it impossible to set a 30 mph limit and expect people to stick to
it as these "perrrrfect" drivers will always exceed it. So what's the
alternative.. speed bumps, cameras and 20 mph limits. Then the same
"perfect" drivers complain that they don't need the cameras, limits and
calming measures when they are the reason they are there. They don't
understand that they are the problem in the first place. They will also
result in the limiters being fitted in cars when the technology is there to
enforce limits on a per road basis and they will complain about that too,
idiots they are.

Obviously, yu dont have one do you. The term variable speed limits does
not mean YOU have a choice, it means that the Traffic Authority has the
ability to vary the limit. If they select 40mph and and you do 45 you
are still stuffed.

Again!.. Safety is not the only consideration.
Maybe they should re-house you next to the M6 so you can appreciate the
reason why traffic should driver slower at night as you obviously don't
care.

Clue if you exceed the variable limit you are speeding, just as if you
exceed the fixed one. Some of you will still think you are better than
everyone else and exceed the variable limit.
And yes I think lowering the speed limits at night to make things quieter
would be a good idea.
I am glad you agree.

He wouldn't like the M42 where there can be different mandatory speed limits
in different lanes.
All are usually set lower than 70 which is just as well as the drivers get
confused by the speed limits and keep changing lane abruptly.
I wonder if he would like a lower speed limit in exchange for more lanes
like the M6?
I know most drivers do as the capacity goes up with extra lanes and goes
down with increased speed.

Its the M25 that makes me laugh, leave it at 70 and the motorway grinds
to a halt after some one panic brakes. you end up sitting in a 10 mile
tailback with no apparent reason for the stoppage. So at busy periods,
they lower the speed limit and the traffic flow speeds up and every one
gets where they are going.
However, Ivor is probably like the idiot who drove around the M25 in 1
hour 20 minutes having set up a camcorder to the Dash of his Porshe
Carrera to film the whole thing. Then sells the DVD on the internet and
is surprised when instead of chasing him, the Police buy the DVD and
used it to prosecute him as he had the Speedo in shot.

The point is he driving is never 'safe'.
Its just more or less safe depnding on many many things.
Of which the speed is the easiest to measure and therer create a
'technical' offence, an probably the least relevant to safety, in
absolute terms.
The rationale for speed limits is more or less then 'we can't bust you
for being a total nutter, driving without looking where you are going,
failing to signal, tailgating, appalling lane discipline, inability to
read road signs, so we will keep you at a speed such that when you have
the inevitable accident, you probably wont kill or be killed'
Its te same with mobile phones..one picture of you with an Iphone
clamped to the lughole, and its an easy conviction.
Its all about easy convictions, not really road safety at all.

So you would sell the DVD and still be surprised and winge about it on
inappropriate Newsgroups

Well I wouldn't do something so idiotic in the first place but if I did I
wouldn't publicise it. I admit to being stupid on occasion but I'm not a
total fool.

?
You are going to have to explain what you are talking about.

I chose to re-house myself close to a motorway. By and large houses
next to a planned motorway, get compulsorily purchased by the highway
authority if they'll be subject to excessive noise pollution.

Trains don't go slower at night and railways tend to run very close to
people's houses / gardens !
Noise pollution is a planning issue. If the houses are there first
then the planners should ensure that a new motorway, or a road newly
widened incorporates noise control measures. Off hand I can think of
lots of high speed roads that have been built or altered to
incorporate noise reduction, including one that runs through a cut and
cover tunnel with nothing except soil on top the reason being it runs
past a school.

When I first started work with British Rail in the 70's I worked in a
shunting yard right next to some fairly new houses. The yard had been
there for years before the houses were built but the people living there
were always complaining. The manager just used to tell them "we were here
first, you decided to buy a house next to our yard..!" We rarely heard
from them again after that ;-)

That's a good principle. Houses were built next to the M1 in Long
Eaton. They had to put up with the noise, but after some years the
traffic had increased and the noise worsened. Noise reduction measures
were then introduced on the motorway. Same alongside the A64 in Leeds,
when it was improved all the houses were sound insulated at the
expense of the highway authority.
At work we once had an important vistor from overseas, I put him in
the best hotel I knew in the locality, The Queen's Hotel in Leeds, it
was certainly the most expensive. It is co-sited with what was then
Leeds City Station. The following morning I picked him up and enquired
about his night's sleep. "It was OK till about 3-30 am" he said, "Then
they started re-arranging all the trains in the station behind the
hotel, I swear it made the wallpaper rustle on the bedroom walls".
