Default T-Mobile Web'n'Walk - use of phone as a modem

T-Mobile prohibits the use of a mobile having web'n'walk data connection as
a 'modem' in conjunction with a laptop/PC. This is fair enough in a way, but
the CD supplied by them with my Nokia N95 contract phone actually installs
software on the PC which permits use as a modem. If I hadn't read the small
print of the contract I would think use as a modem was quite OK - bearing in
mind that T-Mobile is actually providing the tools to set up the phone as a
modem!!

This is rather a 'mixed message' I think you will agree.

Has anybody any thoughts on the matter?

Could/would T-Mobile actually know that the phone was acting as a modem?

T-Mobile Web'n'Walk Plus <- Tier 2
T-Mobile Web'n'Walk Max <- Tier 3 - Use as a modem

Tier 2 = use as a modem
Tier 3 = use of VoIP as well

In theory they could check Tier 1 being used as Tier 2 but they appear
not to. VoIP would be easier for them to detect but I've not tried it.

I did consider swapping to Tier 2 so that I could use MSN. They
appear to firewall it on Tier 1, which is what my n95 lives on.

I just downloaded their Java client and it appears to work perfectly.

Getting to mob.ebuddy.com was a problem as the T-mobile "content
blocker" rated the site as 18+. Had to get the block disabled by
customer services but now it works perfectly.
