my daughter has been hit for 25 and they call this moral.

and they now hide behind the 087 numbers so they don't come under the eyes
of ICSTIS..............

Depending on which mobile operator you come under, they may be able to
block these premium rate services (although IIRC only one of them
bothers their arse doing so)

Try sending a STOP message now, and retain that message in the phones'
memory, and if you don't get an itemised bill, it might be worth doing
so to prove you've asked them to stop.

You then have an auditable point from which you shouldn't receive any
more - and if you do, it should be easy to refer this back to ICSTIS
(although personally, I think the phone operators and the police should
be getting involved with these).

....if all else fails, hit them with a claim for all the money they've
taken - I can't remember if you can claim expenses other than court

It's all done on the balance of probabilities, but if you send a STOP
message and keep getting them, especially if you take this ICSTIS ruling
in with you, I think you'd have a strong chance of winning.

As part of their "evidence" they'll need to prove she "did" sign up,
which seems unlikely given their ICSTIS performance (first para -
Legality), and more than likely in breach of the Data Protection Act as
they can't prove the chain of events that lead to these premium rate
"charges" occurring.

They are, at least, registered with the DPR, as found here:

....otherwise you could have had fun, as the DPR wording is something
along the lines of "guilty of a strict liability offence" if they
weren't registered.
